TERMS OF ENGAGEMENT

1. AUTHORISATION 

Quantum Mortgages Limited is authorised and regulated by the Financial Conduct Authority (FRN 1007949) for Residential and Consumer Buy to Let mortgages. 

For (unregulated) Buy to Let Mortgages and (unregulated) Bridging Lending Quantum Mortgages Limited is not authorised or regulated by the Financial Conduct Authority or the Prudential Regulation Authority. Quantum Mortgages Limited is registered in England and Wales (Companies No. 13628831).

2. OUR SERVICES 

This statement of engagement tells you about our services. It explains the products we are able to recommend, our status and how we are paid. This Terms of Engagement statement will be effective from the date of submission. 

We only offer Unregulated Buy to Let and Unregulated Bridging Lending only from Quantum Mortgages’ own range of products. For the avoidance of doubt these products are not regulated by the Financial Conduct Authority. 

We will always act in your best interests and when you have selected your preferred product we will provide you with information about the loan. This agreement is not a guarantee that funding will be sourced. 

Our firm will be acting as your Lender, offering credit directly to you under the agreed terms of this Terms of Engagement. Please note, we do not act as a Credit Broker in this process

3. SCOPE OF SERVICE 

You will not receive advice or a recommendation from us. You will need to make your own choice about the particular product that will be suitable for you and how to proceed. 

4. OUR CHARGES 

We do not charge a fee for arranging or processing your application. However, certain fees may apply to the mortgage products you choose. These fees will be transparently outlined in the Illustration provided to you prior to entering into the contract.

5. CUSTOMER PRIVACY NOTICE 

Information provided by you may be held, processed, disclosed and used by us, and any associated companies that we use in the provision of your loan. We will hold the personal information provided by you securely and in confidence in our computerised records. By submitting your personal information to us you agree that: any information we hold about you can be held on computer and/or paper files; any information which you give us may be disclosed to selected third parties or group companies for the purpose of administration as permitted by law. Please note that we will not arrange to involve a third party, unless the security and confidentiality of your personal information is assured.

6. WHAT TO DO IF YOU HAVE A COMPLAINT

If you cannot settle your complaint with us, you may be entitled to refer it to the Financial Ombudsman Service at www.financial-ombudsman.org.uk or by contacting them on 0800 023 4 567. 

Please note that the products that we offer are unregulated. The Financial Ombudsman may therefore decide that yours is not a complaint that they can consider further under their service. 

7. LAW 

English law will be the basis of this contract and the language in which this contract will be interpreted, and in which all communications will be conducted, will be English. 

8. YOUR CONSENT/ACKNOWLEDGEMENT 

You acknowledge that you have read this document and understand its content. 

By proceeding to apply for a product with us you acknowledge and consent that: 

  • We may receive commission from the Lender for the arrangement of this agreement, and you have no objections to us receiving this amount. 

  • We intend to rely on this document for the services we provide to you therefore for your own benefit and protection you should read these terms carefully before proceeding.

Customer Mortgage Application Submission Declaration

I/We confirm that:

  1. The submitted application contains information provided by myself/ourselves and the application has been fully and properly completed.

  2. To the best of my/our knowledge, all information provided respects full, correct, accurate and complete and not misleading as at the date of submission.

  3. I/We have not withheld any information or documentation that may be material to the application.

  4. I/We provide my/our express informed consent for a credit and fraud check to be completed.

  5. I/We provide my/our express informed consent for Quantum Mortgages to obtain any references that it considers necessary.

  6. I/We confirm that I/we have provided consent to be contacted by text and/or email to provide electronic ID and Open Banking authorisation

  7. I/We confirm that I/we have provided consent to submit the application               

  8. I/We have been made aware of and provided with the Privacy Notice that is available at https://quantummortgages.co.uk/privacy/

Execution Only Disclosure

Your mortgage contract will be completed on an execution only basis, this means that you are making all the decisions about the suitability of the mortgage for yourself, and you will not receive any advice from Quantum Mortgages.

By proceeding on an execution only basis you accept the following conditions:

  • You will not receive any advice and/or a personal recommendation from Quantum Mortgages as to whether the mortgage meets your specific requirements.

  • Quantum Mortgages will not be obliged to and will not assess the suitability of this mortgage to your individual needs and circumstances.

  • You are waiving any protections that the Financial Conduct Authority’s regulations on mortgage suitability would bring to you.

By accepting these conditions, you confirm that you understand and accept the above conditions and that you are making an informed decision to proceed without advice. 

Please also note that if you have previously spoken to us about this mortgage variation and subsequently decide to proceed with your own choice, accepting this disclosure will invalidate any previous advice given.
